Terms of Use
These terms of use (hereinafter referred to as “these Terms”) determine the terms and conditions for using the online store (hereinafter referred to as the “Service”) provided by Muse International Co., Ltd. (hereinafter referred to as “the Company”) on this website. Registered users (hereinafter referred to as “Users”) shall use the Service in accordance with these Terms.
Article 1 (Application)
These Terms shall apply to all relationships between the User and the Company regarding the use of the Service.
The Company may establish rules, etc. (hereinafter referred to as “Individual Provisions”) regarding the use of the Service, in addition to these Terms. Regardless of the name of the Individual Provisions, they shall be considered as part of these Terms, unless otherwise specified in the Individual Provisions. If the provisions of these Terms conflict with the provisions of the Individual Provisions, the provisions of the Individual Provisions shall prevail, unless otherwise specified in the Individual Provisions.
Article 2 (User Registration)
In using the Service, the applicant shall apply for registration by agreeing to these Terms and following the procedures designated by the Company. The registration will be completed when the Company notifies the applicant of its approval of the registration.
The Company may not approve the application for registration if the Company determines that the applicant falls under any of the following reasons, and shall have no obligation to disclose the reason for the non-approval:
The applicant has provided false information in the application for registration.
The applicant has violated these Terms in the past.
The Company determines that the applicant is not suitable for registration for any other reason.
Article 3 (Management of User ID and Password)
Users shall manage their own user ID and password for the Service at their own risk.
Users shall not transfer, lend, or share their user ID and password with any third party under any circumstances. If the combination of the user ID and password matches the registered information and is logged in, the Company shall consider it as the use by the User who registered the user ID.
The Company shall not be liable for any damages incurred by the use of the user ID and password by a third party, except in cases where the Company has intentional or gross negligence.
Article 4 (Sales Agreement)
In this service, a sales agreement shall be concluded when a user applies to purchase from the Company, and the Company notifies the user of its acceptance of such application. Ownership of the product shall be transferred to the user when the Company hands over the product to the delivery company.
The Company may terminate the sales agreement without prior notice to the user if the user falls under any of the following reasons:
The user violates this agreement
The delivery of the product cannot be completed due to an unknown delivery address or long-term absence
The trust relationship between the user and the Company has been damaged
Regarding payment methods, delivery methods, cancellation methods for purchase applications, or return methods related to this service, they shall be determined separately by the Company.
Article 5 (Intellectual Property Rights)
The copyrights and other intellectual property rights of the content (including product photos) provided by this Service belong to the rightful owners, including us and the content providers. Users are prohibited from reproducing, reprinting, modifying, or any other secondary use of the content without permission.
Article 6 (Prohibited Acts)
Users are prohibited from engaging in the following acts when using this Service:
Acts that violate laws or public order and morals
Acts related to criminal activities
Acts that infringe on copyrights, trademark rights, and other intellectual property rights included in this Service
Acts that destroy or interfere with the functionality of our servers or network
Acts that use the information obtained through this Service for commercial purposes
Acts that may obstruct the operation of our services
Acts of unauthorized access or attempted unauthorized access
Acts of collecting or accumulating personal information of other users
Acts of impersonating other users
Acts that directly or indirectly provide benefits to antisocial forces in connection with our Service
Any other acts deemed inappropriate by us.
Article 7 (Suspension of Service, etc. of the Service)
In the event that any of the following reasons are determined by the Company, the Company may suspend or interrupt all or part of the provision of this Service to the User without prior notice:
When conducting maintenance or updates of the computer system related to this Service
When it becomes difficult to provide this Service due to force majeure such as earthquakes, lightning strikes, fires, power outages or other natural disasters
When the computer or communication line is stopped due to an accident
In any other case where the Company deems it difficult to provide this Service
The Company shall not be responsible for any disadvantage or damage suffered by the User or a third party due to the suspension or interruption of the provision of this Service, regardless of the reason.
Article 8 (Restrictions on Use and Deletion of Registration)
In the event that any of the following apply, the Company may restrict the User’s use of all or part of this Service or delete the User’s registration without prior notice to the User:
The User has violated any provision of these Terms and Conditions;
False information is found in the registered information;
The credit card provided by the User for payment has been suspended;
The User has failed to fulfill payment obligations;
The User has not responded to contact from the Company within a certain period of time;
The User has not used this Service for a certain period of time since the last use;
The Company determines that the User’s use of this Service is inappropriate.
The Company shall not be liable for any damages incurred by the User as a result of actions taken by the Company pursuant to this Article.
Article 9 (Withdrawal)
Users may withdraw from this Service by following the prescribed withdrawal procedures.
Article 10 (Disclaimer and Limitation of Liability)
The Company does not guarantee that this Service is free from defects (including, but not limited to, defects in safety, reliability, accuracy, completeness, effectiveness, suitability for a particular purpose, security, errors, bugs, and infringement of rights).
The Company shall not be liable for any damages incurred by the User as a result of using this Service. However, if the contract between the Company and the User regarding this Service (including these Terms and Conditions) is a consumer contract as defined by the Consumer Contract Act, this disclaimer shall not apply. Even in such cases, the Company shall not be liable for any damages incurred by the User as a result of the Company’s negligence (excluding gross negligence) or tort, except for special damages arising from special circumstances (including cases where the Company or the User could foresee or have foreseen the occurrence of damages).
The Company shall not be liable for any transactions, communications, or disputes between the User and other Users or third parties arising from or related to this Service.
Article 11 (Changes to the Service, etc.)
The Company may change the contents of this Service or suspend the provision of this Service without notice to the User, and shall not be liable for any damages incurred by the User as a result.
Article 12 (Change of Terms of Use)
The Company may, when deemed necessary, change these Terms of Use without prior notice to the user. However, if a user starts to use the Service after the change of these Terms of Use, the user is deemed to have agreed to the revised terms.
Article 13 (Handling of Personal Information)
The Company shall handle the personal information acquired through the use of this service appropriately in accordance with the “Privacy Policy” of the Company.
Article 14 (Notice or Communication)
Notice or communication between the user and the Company shall be made through the method determined by the Company. Unless the user submits a change notification to the Company in the manner specified separately by the Company, the contact information currently registered shall be deemed valid, and the Company shall send notifications or communications to such contact information, which shall be deemed to have reached the user at the time of transmission.
Article 15 (Prohibition of Assignment of Rights and Obligations)
The user shall not assign or pledge to a third party the position or the rights or obligations under this Agreement without the prior written consent of the Company.
Article 16 (Governing Law and Jurisdiction)
The interpretation of this Agreement shall be governed by the laws of Japan. However, the application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded in connection with this service. In the event of a dispute regarding this service, the exclusive agreed jurisdictional court shall be the court with jurisdiction over the location of the Company’s head office.
